Welcome to GameConnex, a platform for connecting gamers through chat, messaging, and community features (the "Service"). By accessing or using the Service, including our website at gameconnex.com, mobile apps, or any related tools, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use the Service. These Terms form a binding legal agreement between you and GameConnex, Inc. ("we," "us," or "our").

We may update these Terms from time to time. Continued use of the Service after changes constitutes your acceptance of the revised Terms. We will notify you of material changes via email, in-app notice, or by posting on our website.

1. Eligibility and Age Restrictions

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you are under 18, you must have parental or guardian consent. By using the Service, you represent that you meet these requirements and have the legal capacity to agree to these Terms. We do not knowingly collect data from children under 13 and comply with applicable laws like COPPA.

2. Use of the Service

You agree to use the Service only for lawful purposes and in a manner that does not infringe on the rights of, or restrict or inhibit, anyone's use and enjoyment of the Service. You are responsible for ensuring your use complies with all applicable local, state, national, and international laws.

Prohibited uses include, but are not limited to:

• Sharing explicit, violent, or illegal content.
• Impersonating others or misrepresenting your identity.

3. User Accounts

You are solely responsible for all activities under your account. We reserve the right to suspend or terminate accounts for violations or suspicious activity.

4. User Content

"User Content" includes any text, images, videos, or other materials you submit, post, or transmit via the Service (e.g., chat messages, profiles, or uploads).

• Ownership: You retain ownership of your User Content.
• License Grant: By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, distribute, modify, display, and perform it in connection with operating, promoting, and improving the Service. This includes sublicensing to third parties (e.g., for content moderation).
• Representations: You warrant that your User Content does not violate third-party rights (e.g., copyrights, privacy) and that you have permission for any third-party materials.

We may remove or edit User Content at our discretion, especially if it violates these Terms.

5. Chat and Messaging Features

The Service includes real-time chat and messaging. You agree:

• To respect user privacy—do not share personal information without consent.
• Not to use automated tools (e.g., bots) for messaging unless explicitly allowed.
• That messages may be monitored for safety and compliance.
• To report abusive behavior via in-app tools.

We use end-to-end encryption where possible but cannot guarantee absolute security.

6. Intellectual Property

The Service, including its design, code, logos, and trademarks, is owned by us or our licensors. You may not copy, modify, or commercially exploit any part without written permission. User Content does not imply ownership transfer to us.

7. Privacy and Cookies

We use cookies and similar technologies to enhance functionality, analyze usage, and personalize experiences. 9. Termination

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted access, error-free operation, or that content is accurate or secure.

11. Limitation of Liability

To the fullest extent permitted by law, GameConnex, its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the Service, even if advised of the possibility. Our total liability shall not exceed $100 or the amount you paid us in the past 12 months, whichever is greater.

12. Indemnification

You agree to indemnify and hold us harmless from claims arising from your User Content, violations of these Terms, or infringement of third-party rights.

13. Dispute Resolution

These Terms are governed by the laws of the State of California, USA, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts in San Francisco County, California. You waive any jury trial rights.

We encourage informal resolution first—contact us before legal action.

14. Miscellaneous

• Severability: If any provision is invalid, the rest remain enforceable.
• No Waiver: Our failure to enforce a right does not waive it.
• Entire Agreement: These Terms, plus our Privacy Policy, constitute the full agreement.
• Force Majeure: We are not liable for delays due to events beyond our control.
